Terms of Service

By commissioning me, you agree to these terms and will be held accountable for reading and understanding the following terms. You will be held accountable for any policies that are broken after the commission is complete.

Ivieth’s Terms of Service

By commissioning me, you agree to follow these terms:

  • You may give a purchased design a name, story, world to live in, etc, for personal use.

  • You may change colors, patterns, clothing, species, and features as you see fit.

  • You may trade a design away for other designs, artwork, or currencies from other people to compensate for funds spent during the initial purchase. When doing so, you are required to credit me for the original design of the character. You may only sell the design for a greater price than the original cost with the stipulation that it has additional commissioned art; this means you cannot trade the design alone for more than what you bought it for.

  • You must credit me for the design when you first use it or when someone inquires about its origins. You are by no means allowed to claim to be the creator.

  • You may repost my designs and artwork, but you MUST credit me, link to one of my accounts, and leave my signature/watermark on the piece. Failure to comply or the blatant removal of my watermark is considered plagiarism and art theft and you will be reported.

  • Artwork of your characters may be used as references for your character on other sites. The same conditions in the last term applies to this as well.

  • Any price paid towards my work will not be charged back at a later date. If this does happen, it will result in an automatic blacklist and withdrawal of ownership of any design included in the payment. If it is artwork of your character, I may convert it into a ‘your character here’ opportunity to cover lost funds.

  • You may not by any means use my art for commercial purposes unless purchased for that reason under agreement.

  • Commissioned works are never to be used in the training of Artificial Intelligence (AI) image generators, or reiterated, remixed, or reworked via the use of AI programs which includes finishing commissioned sketches using AI (this will result in being blacklisted)

If you would like to use a design for commercial purposes, please inquire about it with me first! We can work something out. But selling my art of your character is a no go. Absolutely do NOT use my art for any kind of NFT - I don’t allow this under any circumstance!By commissioning or purchasing from me, you understand that I may use the designs and artwork I have drawn initially in my portfolio or for personal promotion. The designs belong to you, but the artwork remains mine and mine alone.By commissioning or purchasing from me, you understand that if you disregard or violate any of these terms, you will be contacted and asked to abide by my terms; if you refuse or ignore my requests, you will be blacklisted and further action will be taken depending on the situation.

Availability

I’m a student at a university so at times work might be slower. In those cases you’ll be informed after contacting me regarding a commission for the first time.
I have an active queue that I keep updated (which you can keep track of on my Trello). I work on commissions in order, but may work on pieces further in the queue while I wait for approval/input on works in progress updates sent to the first client in my queue.

RIGHTS AND REFUNDS

What you can and can’t do with my work

Once the request, money, and completed work (the commission) has transferred between me (the creator) and the customer (you), the design becomes yours and artwork can be reposted. If you commission me for a design, you are buying the rights to said design and may use it however you desire with the exclusion of commercial use. If you purchase artwork of your intellectual property, you receive little rights to the actual artwork itself but may repost the artwork anywhere with proper credit.

Refunds

Hence I settle for prepayment or payment plans you can request a refund before the artwork is finished. The refund will be issued for the part of the work that haven't been finished at the time of requesting the refund. After artwork is finished no refund will be issued. If there was no agreement about a deadline for the piece the refund won't be issued due to me "taking too long". I'm trying to deliver a high quality product in the shortest time possible.In regards to completed character artwork, refunds are not offered once completed. If you refuse to pay for a finished piece, you will be blacklisted and will not receive the finished piece until paid for (in case of a payment plan, since most of the time I prefer prepayment).
In regards to character designs, if you opt to return work, you will receive a refund and my rights to the design are reinstated. This goes for forced refunds through paypal as well - once payment is retracted, you no longer have any rights to the design. Ownership is returned to me. This includes pre-made designs and customs.
If the payment is not made, our agreement is void and the character is mine until the money is received. If you ignore my requests for payment, do not reply to my messages, or refuse to pay within a time limit of 48 hours after agreement of the transferral of ownership, I retain full rights to the design and may do what I please with it. In terms of auctions, the design will go to the next highest bidder for the price they offered. A customer also voids the contract if they issue a refund through paypal without prior notice, discussion, or permission. In doing this, the customer forfeits all rights to the design and returns all rights to me. If the customer insists on continued use of the character without rights, admins will be contacted and I will notify the public of your lack of rights to the design. Continuous transgressions will result in blacklisting.

BLACKLIST

What actions would result in blacklisting?

1. If you issue a refund/chargeback through paypal without notice or prior agreement, refuse to respond to my inquiries regarding the matter, and/or refuse to resend the money, the following will take place:

  • you will be blacklisted and barred from commissioning me in the future

  • I will notify those within my communities of your action

  • you and your actions will be addressed publicly to warn other artists not to take commissions from you.

  • If a design is involved, you void all rights and ownership to it and I may do what I please with it.

2. If you claim any of the work I did for you as your own or refuse to credit me.3. If you alter the image in any way. This includes, but is not limited to: erasing my watermark/signature, ‘fixing’ any errors, or doing any kind of editing without my approval.
